RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT ("AGREEMENT") IN CONSIDERATION OF BEING PERMITTED TO PARTICIPATED IN ANY WAY IN EVENT ("ACTIVITY") AT ANY TIME DURING THE CURRENT CALENDAR YEAR 1, FOR MYSELF, MY PERSONAL REPRESENTATIVES, ASSIGNS, HEIRS, AND NEXT OF KIN:
1. ACKNOWLEDGE, agree, and represent that I understand the nature of the activity and that I am qualified, in good health, and in proper physical condition to participate in such activity. I further agree and warrant that if, at any time, if I believe the conditions to be unsafe I will immediately discontinue further participation in activity.
2. FULLY UNDERSTAND that: (a) THIS ACTIVITY INVOLVES RISK AND DANGER OF SERIOUS BODLY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS, COVID-19, AND DEATH(' RISK'); (b) these risks and danger may be caused by my own actions or inactions, the actions or inactions of other participating ninth activity, takes place, or THE NEGLIGENCE OF THE "RELEASES" NAMED BELOW; (c) there may be OTHER RISK or SOCIAL AND ECONOMIC LOSSES either not known to me or not readily foreseeable at time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISK AND ALL RESPONSIBILITY FOR LOSSES, COST, AND DAMAGES 1 incur as a result of my participation or that of the minor in the activity.
3. HEREBY RELEASE, DISCHARGE AND COVENANT NOT TO SUE the sanctioning organization(s), they administrators, directors, agents, officers, member, volunteers, and employees, other participants, officials, rescue personnel, sponsors, advertisers, owners, lessees of premises on which the activity is conducted,(each of foraging shall be considered on of the RELEASES herein) FROM ALL LIABILITY, CLAIMS, DEMANDS,LOSSES, OR DAMAGES ON MY ACCOUNT CAUSED OR ALLEGED TO BE CAUSED, ON A WHOLE OR IN PART BY THE NEGLIGENCE OF THE RELEASE OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS, AND I FURTHER AGREE THAT IF DESPTE, THIS RELEASE AND THE WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNIFY,SAVE, AND HOLD HARMLESS EAHC OF THE RELEASEES from any litigation expenses, attorney fees, loss liability, damage, or cost which may be incurred as the result of such a claim.
4. Corona virus cover 19 warning disclaimer. corona virus is extremely contagious and it spreads easily from person to person contact.federal and state recommend social distancing as a means to spread the virus. COVID 19 can lead to personal injury, severe illness and death. DOG POUND MMA& fitness in no way warrants infection will not occur while in participation in programs. the undersigned agrees that themselves and children who enter the facility are at risk. participants will quarantine for 14 days after (i) returning from highly impacted areas subject to CDC Level 3 travel health notice,(ii) exposure to any person returning from those areas subject to CDC level 3 travel health notice, or (iii) exposure to any person who has suspected or confirm case of COVID-19. the CDC travel health network is a continuously updating this list and the undersigned agrees that they are aware of this a list and the countries listed.
5. The undersigned agrees to check the CDC travel health notices list prior to utilizing the facilities, services, and programs of company, on a daily basis if necessary. the undersigned hereby agrees, represents, and warrants that neither the undersigned nor such participating children shall visit or utilize the facilities, services, and programs of company if he or she i) experiences symptoms of COVID-19, including without limitation, fever, cough, or shortness of breath, or (ii) has a suspected or diagnosed/ confirmed case of COVID-19. the undersigned agrees to notify company immediately if he or she believes that any of the foregoing access/use restrictions may apply. the undersigned acknowledges and assumes both the known and potential dangers of utilizing the facilities, services, and programs of the company and acknowledges that use of thereof by the undersigned and/or such participating children may, despite the company reasonable efforts to migrate such dangers, result in exposure to COVID-19, which could result in quarantine requirements, serious illness, disability, and/or death.
I ACKNOWLEDGE THAT I AM 18 YEARS OR OLDER HAVE READ THIS AGREEMENT FULLY AN DI UNDERSTAND THE TERMS. I UNDERSTAND THAT I HAV EGIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND WTHOUT INDUCEMENT OR ASSURANCE OF ANY NATURE AND I INTENT IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THE BALANCE NOT WITH STANDING SHALL CONTINUE IN FULL EFFECT.
